This seminar will provide the estate planner and litigator with a background on the development of HEMS through federal legislation and case law, while providing a practical approach on how a HEMS standard in a trust is actually administered through the perspective of the corporate trustee panelist with specific case examples. The litigation aspect will focus on strategies both for limiting the trustee’s exposure to liability when making distributions under the HEMS standard and for asserting a beneficiary’s right when a HEMS standard is applied.

Email accounts, facebook pages and other digital assets have become ubiquitous in our society. However, when an individual dies holding digital assets, a fiduciary may have to contend with federal privacy laws, “anti-hacker” criminal laws and binding terms of service in order to properly administer the estate or trust. This presentation provides an overview of the laws governing digital assets with a focus on California’s draft (or hopefully, enacted by the time of the symposium!) legislation, including suggestions for careful planning and administration.
