  • An attorney’s duties regarding an impaired colleague
  • How to discuss possible impairment issues with a colleague
  • Developing a self-care plan and wellness strategies
  • Knowing where to find help, including the Lawyer Assistance Program and other resources

Settlor Incapacity: A Brave New World of Trust Administration

What are an attorney’s ethical duties when clients have diminished capacity and how are those duties affected by the different “levels” of capacity? What are the duties and responsibilities for fiduciaries when a settlor becomes incapacitated, both to the present beneficiary and to the remainderman? And finally, what are the rights or obligations of heirs or beneficiaries of an incapacitated settlor who believe that harm has occurred to the settlor or the trust?

We will analyze what is currently missing from your workplace that would create the psychological safety your staff is looking for to feel comfortable playing, and determine the initial steps you need to take to create an environment where staff can do their most vibrant work.
